An asbestos defense attorney can assist in ensuring the financial security of those harmed by exposure to this toxic mineral. Compensation can cover medical costs, funeral and burial costs, lost quality of life, and suffering and pain.

Our lawyers serve as national, regional and local counsel in large toxic tort litigation. As such, we are familiar with the unique issues and the complex science that go along asbestos cases.

New York Asbestos Lawsuits

Asbestos fibers are deadly and can trigger serious medical conditions such as mesothelioma. A New York asbestos attorney is adept at handling lawsuits to seek financial compensation for victims of asbestos exposure and their families. These cases can be extremely complex and it is crucial to have a mesothelioma expert lawyer on your side.

New York has a long history of asbestos settlement litigation and many residents have been exposed to this dangerous substance. In recent times there have been more lawsuits against former asbestos manufacturers than ever before. These cases arise out of the realization that asbestos is associated with diseases such as mesothelioma and lung cancer. These companies were aware asbestos's dangers however, they failed to inform their employees and customers.

The New York City area is particularly susceptible to asbestos-related ailments because of its older structures and numerous construction sites. Brooklyn Navy Yard is a notoriously hazardous area that continues to affect the surrounding community.

Many workers were exposed to asbestos at work. In addition, exposure to asbestos through secondhand sources can result in mesothelioma. This includes spouses who wear their husband's clothes to work and come into contact with asbestos dust frequently.

The mesothelioma litigation can be costly for defendants, especially when they are incorrectly named as defendants. According to a study, more than 3,600 lawsuits have been filed in New York courts since 2014, and the number could increase even more. This kind of litigation is usually supported by asbestos law firms that advertise on television during the day and encourage victims to file claims, with the promise of substantial settlements.

Defendants may be able to mitigate some of the costs arising from these cases by asserting that their policy periods expire or they are only responsible for a tiny percentage of the total amount of the claim. New York law does not have a specific rule for how to divide responsibility when the alleged exposure is of and outside the insurance policies.

Asbestos-related Illnesses

Exposure to asbestos can lead to a wide range of diseases. The most serious condition is mesothelioma. Mesothelioma has led to the deaths of many people. Other asbestos-related diseases include asbestosis and lung cancer. Pleural plaques and pleural effusion are also asbestos-related.

Mesothelioma is a rare, but fatal illness that is caused by asbestos fibers that accumulate in the lungs. They then irritate the linings of the ribcage (the pleura), chest cavity and abdominal cavity. Inhaling these fibers can lead to scarring in the lungs. This is known as asbestosis. It can also cause thickened patches of pleura (pleural plaques) or a more extensive fibrosis. Pleural plaques or diffuse fibrosis may decrease lung capacity, as measured by a breath test. They can also cause pain and difficulties in breathing, but they do not lead mesothelioma or cancer.

Most of the time, symptoms of asbestos-related illnesses don't manifest until decades after initial exposure. This is because it could take between 20 to 50 years for the exposure to asbestos fibers to cause lung damage. Workers who handled, cleaned, and removed asbestos from their workplaces and their spouses, children and other people who are exposed to asbestos are at risk of developing mesothelioma.

In addition to mesothelioma, other asbestos-related illnesses include laryngeal cancer, lung cancer, peritoneal mesothelioma, and ovarian mesothelioma. Ovarian cancer is the most fatal form of mesothelioma for women, but it is less prevalent than mesothelioma in general. It is usually diagnosed later than other kinds of mesothelioma due to the fact that it develops in the lining of the reproductive organs and symptoms can be similar to those of other diseases.

A number of companies employed asbestos in the 20th century, but they knew that it was hazardous. They exposed thousands of people to asbestos when they failed to remove it from their products. Now, those exposed are able to sue for financial compensation. Many asbestos-related companies are insolvent. The victims are now able to claim compensation from the trust funds established by bankruptcy courts.

A panel of six Supreme Court judges will review every case in NYCAL to decide whether or not to take it up with it. Judges will also consider the merits of each claim to determine the amount of money each plaintiff should receive.
